Reasons
1. Basic facts
A. The Plaintiff lent money to the Defendant for a considerable period of time. On January 20, 2016, the Plaintiff settled and finalized the amount of the Plaintiff’s loan to the Defendant as of January 20, 2016 at KRW 138,00,000, and thereafter, on June 16, 2016, the Plaintiff lent KRW 252,90,000 in total to the Defendant without any agreement on the due date as stated below (the amount of the Plaintiff’s loan and the Defendant’s repayment statement) until June 16, 2016, and on June 2, 2016, the Plaintiff subrogated for the Defendant.
In a summary brief of October 30, 2017, the Defendant recognized a total of KRW 272,900,000 (=loan amount of KRW 252,900,000) as the Plaintiff’s loan and indemnity amount of KRW 272,90,000.
