1. Basic facts

A. The Plaintiff and the Defendant are as between March 2015 and November 2018, respectively.

B. From May 26, 2015 to July 5, 2018, the Plaintiff wired total of KRW 89,740,000 to the Defendant’s deposit account in the name of the Defendant or the deposit account in the name of C requested by the Defendant, as indicated in the “Transfer Contents List” as follows.

C. Meanwhile, between June 25, 2015 and August 5, 2018, the Defendant remitted total of KRW 2,110,000 to the Plaintiff on 12 occasions.

After the Plaintiff’s decision with the Defendant, the Plaintiff filed a criminal complaint with the Defendant stating that “The Defendant, as described in Nos. 1, 5, 6, 9 through 11, 13, 14, 17 through 32, 37, and 40 in the table of remittance from May 26, 2015 to July 5, 2018, he/she acquired the Defendant a total of KRW 73,690,000 in total over 28 times, as in the table of remittance No. 1, 5, 6, 9 through 11, 13, 14, 17 through 32, and 37 through 40, the public prosecutor of the Gwangju District Public Prosecutor’s Office did not institute a non-prosecution disposition
