1. Basic facts

A. On August 2012, the Plaintiff and B concluded a partnership agreement with the purport of establishing and operating a corporation for the purpose of manufacturing construction materials manufacturing business.

B. The Plaintiff and B established the Defendant on January 15, 2013 in accordance with the foregoing business agreement.

The Plaintiff asserted by the parties: (a) on January 31, 2013, the Plaintiff leased KRW 20 million to the Defendant on a 32-round July 30, 2014 by setting the interest rate of KRW 395,50,000 annually and at the end of the following month from the maturity date; (b) on October 30, 2013 and April 8, 2014, the Plaintiff was unable to receive the remainder of the loan that was paid a total of KRW 30 million from the Defendant; (c) as such, the Defendant was not given the remainder of the loan to the Plaintiff.
