1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. On April 9, 2010, the Plaintiff concluded an insurance contract with Nonparty B (B; hereinafter “B”) who is the Defendant’s female living together with the Defendant and entered into an insurance contract with the same content as indicated in the attached Form [Attachment] as the insured (hereinafter “instant insurance contract”).
The Defendant was hospitalized in a hospital for a total of 253 days from July 2, 2010 to May 13, 2014, as indicated in the following specifications of payment of insurance proceeds, and received medical treatment from the Plaintiff in total in accordance with the insurance contract of this case. The Defendant received insurance proceeds of KRW 5,920,000 from the Plaintiff.
