A Imprisonment with prison labor of one year and six months, and Defendant B shall be punished by imprisonment with prison labor of ten months.

Punishment of the crime

Defendant A, “2017 Highest 488, 2018 Highest 206,” was the head of C village, and Defendant B was the head of C fishing village village fraternity.

The Defendants conspired to dispose of 14,712m2 and 593m2 of forest land E owned by Dondo-gun, Jeonnam-do without the consent of village residents, to F, etc.

1. On February 27, 2017, the Defendants: (a) around HAD office located in Hado-gun, Jeonnam-do; (b) had HADD, who is aware of such fact, sell F in advance the price of KRW 14,712 square meters in Do-gun, Jeonnam-do-gun; and (c) have written community rules and written resolutions stating that “E shall donate forest land to I; and (d) affix the seal of village residents in advance on the name of village resident.”

As a result, the Defendants forged 1 copy of the village agreement in the name of C, which is a private document on the rights and duties or certification of facts for the purpose of exercising, and 1 copy of the resolution.

2. On February 27, 2017, the Defendants: (a) at the Do registry office of 57 in the central road of Chungcheongnam-do, Chungcheongnam-do; (b) had HA certified judicial scrivener file an application for ownership transfer registration of the said forest; and (c) had HA certified judicial scrivener submit forged village rules and resolution as if they were genuine to the registered public official who knew of such fact; and (d) exercised them respectively.

3. The Defendants, on February 27, 2017, filed an application for registration of ownership transfer with a certified judicial scrivener H, who is aware of the fact, without a general meeting of the village that would transfer ownership to F or I the forest owned by C, shall submit the application for registration of ownership transfer to F or I, and shall have a registered public official who is aware of the fact submit the application for registration of ownership transfer to F on February 27, 2017 to F on the land register of land in D, on the ground of sale and purchase from F on February 27, 2017, and to I on the land register of land in E.
