A defendant shall be punished by imprisonment for two years.
Reasons
Punishment of the crime
No person shall manufacture, import, store, transport, keep in custody or sell fake petroleum products.
1. The Defendant who manufactures fake petroleum products from around February 23, 2016, along with D, the same year.
3. By February, 200, he leased “F gas station” located in Pyeongtaek-si E and operated it as a club business, and made approximately 74,486.18 L (liter) of fake transit by mixing them with oil such as light oil, scarcity, and light oil identification removal agents, etc.
Accordingly, the defendant manufactured fake petroleum products in collusion with D.
2. The Defendant, along with D, stored fake petroleum products at the same time, at the same place as that of paragraph (1) and at the same time and place as that of paragraph (1), equipped with double tank facilities, etc., in which double valves are installed so as to enable the selection and oiling of normal petroleum products and fake petroleum products, and purchased approximately KRW 74,486.18 L (litter) of fake transit directly manufactured as set forth in paragraph (1) and Macheon-si G in the tank, and stored approximately 59,643.19 L (litter) of fake gasoline mixed with petrochemicals.
Accordingly, the defendant stored fake petroleum products in collusion with D.
3. The Defendant sold approximately KRW 111,529.37 L ( liter) among the fake petroleum products manufactured or purchased as above, and approximately KRW 39,643.19 (liter) among the fake petroleum products that he/she manufactured or purchased at the same place as D and at the same time and time as D, at approximately 111,529.37 L (liter).
Accordingly, the defendant sold fake petroleum products in collusion with D.
