Defendant
A is a person who operates the F Freight and eight cargo vehicles, and Defendant B is a person who operates one cargo vehicle G, and Defendant C is a person who actually operates the “I gas station” located in H of Daegu achieved Group H. Defendant C paid a false oil purchase card as if Defendant A and B paid a certain amount of money in return for the use of the said gas station, and the excess amount paid after Defendant A and B paid a false oil purchase card to Defendant A and B, and Defendant A and B conspired to receive subsidies from the local government through false credit card transactions as above.
1. Defendant A, even though Defendant A actually distributed to F cargo vehicle in the instant gas station between January 201 and January 2012, he/she was aware of the F cargo vehicle via the 1,782-liter’s via the 2,528-liter’s via the 2,528-liter’s fuel, he/she paid a false oil purchase card by pretending that he/she had the 2,528-liter’s via the 2,528-liter’s fuel, and the oil amounting to 746-liter’s subsidy amounting to KRW 257,773 was remitted from the local government having jurisdiction over the victim who was unaware of the fact through the subsidy management system.
In addition, from around that time to May 2015, the Defendant received subsidies from the local government having jurisdiction over the victim to transfer them to the agricultural bank account in the name of the Defendant, and acquired pecuniary profits by falsely paying the oil purchase card by pretending that the amount of the oil purchase card is more than the actual share (such as the list of crimes Nos. 1 through No. 8) and as shown in the list of crimes No. 63,980,583.
2. Defendant B paid a false oil purchase card by pretending that he/she had the transit of 2,151 liter at the above oil station during the month of January 2012, despite the fact that he/she had the transit of 2,151 liter in fact at the above oil station, and he/she paid a false oil purchase card in the same manner as 2,870 liter limited liability.
