Reasons
Punishment of the crime
1. Defendant A is a person who is engaged in the duties of driving Cone Stars.
At around 18:00 on November 6, 2012, the Defendant was driving the said spared with the front road in Bocheon-si, Bocheon-si, with the view to the shooting distance of the New Spare.
At night at the time, the EM5 car driven by the victim D (ma, 47 years old) was stopped in order to turn to the left at the Han-do level. In this case, a person engaged in driving of a motor vehicle has a duty of care to live well on the front side and to prevent accidents by securing safety distance.
Nevertheless, the Defendant neglected this and found the victim's driver's car in a stop at the latest after the vehicle was driven by negligence, and the Defendant received the victim's driver's rear part of the driver's car.
Ultimately, the Defendant, by occupational negligence, sustained injury to the victim, such as the definite base for treatment for about four weeks, and at the same time escaped without immediately stopping and taking necessary measures, such as providing relief to the victim, even though the Defendant destroyed the victim’s driver’s car to have an amount equivalent to KRW 8,480,263.
2. Defendant B is an employee of “G cafeteria” on the top of the F musical shop operated by Defendant A, who was aware of the fact with A.
On November 6, 2012, at around 18:20, the Defendant made a false statement to the effect that “I would like to make a statement that I had a low drinking and drive instead of the driver's license,” and that I would like to make a false statement to the police officer of the Boan Police Station, who was conducting a field investigation at the same time, around 19:00 on the same day, at the site of the accident described in the above paragraph (1).
Accordingly, the defendant, who committed a crime corresponding to a fine or heavier punishment, was allowed to escape.
