A defendant shall be punished by imprisonment for four months.
Reasons
Punishment of the crime
1. Larceny;
A. At around 02:00 on July 20, 2020, the Defendant entered the victim C’s possession of each of the larcenys in the indictment as “the ownership of the victim C” with regard to the owner of each of the larcenys in this case at night, which was located in the presence of the victim due to the lack of access by people, and the lack of surveillance. However, according to the C’s written statement, C entered as an employee of E, and the Defendant’s punishment was written in consultation with E, and E corporation submitted a written agreement. In light of the fact that E corporation is the victim of each of the larcenys in this case, and E corporation does not want punishment against the Defendant, the victim of each of the larcenys in this case appears to be “E corporation.”
In addition, seven support units for the 3.60,000 won of the market in possession were stolen by means of loading them on the D Poter vehicle operated by the Defendant.
B. At around 02:30 on July 20, 2020, the Defendant: (a) committed a theft by carrying eight of the 390,000 won support unit for the victim C’s market price owned by the Defendant on the Dpoter vehicle, which was located at night on the road near the Dogjin-gun, Gangnam-gun; (b) there was no passage of people; and (c) there was a gap in surveillance by failing to pass by people.
C. At around 04:00 on July 20, 2020, the Defendant: (a) at night around H elementary school located in Gangnam-gun G, Gangnam-gu, Jinnam-gun; (b) at night, there was no passage of people; and (c) at night, there was a gap in surveillance due to the lack of access by people; and (d) at the victim C’s market price owned by the Defendant, seven persons with a support unit of KRW 330,000,000 were stolen by loading on the D
2. No person who violates the Guarantee of Automobile Accident Compensation Act shall operate any vehicle on a road which is not covered by mandatory insurance;
Nevertheless, at around 02:00 on July 20, 2020, the Defendant operated D Poter freight cars without mandatory insurance.
