1. The Defendant’s KRW 30,712,00 and the Plaintiff’s annual rate of KRW 5% from February 4, 2014 to June 24, 2016, and the following.
Reasons
1. Basic facts
A. The status of the parties is the primary subcontractor of Samsung Electronic Co., Ltd. (hereinafter “Tsung Electronic”), with the aim of manufacturing and selling electronic components, software development, etc., and the Plaintiff is a company with the objective of manufacturing semiconductor parts and manufacturing semiconductor display displays.
B. On November 15, 201, the Defendant entered into a development services contract, upon receipt of a request for the supply of a prob card (a model name S5L8945, Probbe: a device connecting semiconductor chips and testing equipment on a prob card to inspect semiconductors’ action, which is called a device connecting semiconductor chips and testing equipment on the prob card, and sending electricity, and selecting semiconductor chips entering the same time, and on November 23, 201, between the Plaintiff and the Plaintiff on November 23, 2011, and the Plaintiff made a prob card (a model name S5L8945, hereinafter “8945 card”) and supplied it to the Defendant (hereinafter “instant development services contract”).
Article 2 (Implementation of Contracts) of the Development Services Agreement is as follows. 1. The plaintiff must deliver to the defendant the developed product specified in the "Inform of Card Production" attached to this Agreement, according to the agreed payment period.
2. The Plaintiff must request the Defendant to examine the details indicated in the supply list according to the inspection items and test procedures of the card manufacturing Informization presented by the Defendant in order to prove the performance of the developed products.
Article 4 (Final Supply) The criteria for the examination under Article 3 (2) above shall be based on the Inform of Card Production, as set by the Defendant, presented to the Plaintiff.
