Defendant
A Imprisonment with prison labor of two years and six months, and Defendant B shall be punished by imprisonment of one year and six months, respectively.
However, as to Defendant B, the same shall apply.
Reasons
Punishment of the crime
1. Defendant A
A. The Defendant is not a narcotics handler.
1) On July 2017, the Defendant: (a) around the exit No. 12, HH located in Yeongdeungpo-gu, Seoul; (b) sold a chroopon with approximately KRW 300,000,000 from I, and sold a chroopon, which is a local mental medicine, (c) approximately 0.7g of a chroopon.
2) On July 27, 2017, the Defendant: (a) around 20:0, on the front road located in the Yeongdeungpo-gu Seoul Metropolitan Government J; (b) obtained approximately 0.75g of philopon from L, and sold philopon to M via L with KRW 0.75g of 200,000.
Accordingly, the defendant conspired with L to sell philophones.
3) On August 8, 2017, the Defendant: (a) sold phiphonephones with approximately KRW 2g 900,000, in the places described in paragraph (2) around 20:0; (b) L via L, with approximately KRW 2g 90,00,000.
Accordingly, the defendant conspired with L to sell philophones.
4) On August 13, 2017, the Defendant: (a) received 2.5 million won from M and sold a philophone with a dry volume of 2.5 million won; and (b) sold a philophone.
5) On August 18, 2017, around 00:00, the Defendant sold 0.7g philophones by receiving KRW 300,00 from B, and selling 0.7g philophones at the office located in Yeongdeungpo-gu Seoul Metropolitan Government N.
6) On August 26, 2017, around 20:00, the Defendant sold 0.7g philophonephones by receiving KRW 300,00 from I and selling 0.7g philophones.
7) On September 16, 2017, the Defendant: (a) received KRW 600,000 from P and sold 2g philopon in a philopon with approximately KRW 600,000 from P and sold 2g philopon.
8) On October 11, 2017, around 22:00, the Defendant: (a) sold a philopon of 0.7g philopon by receiving KRW 300,000 from B; and (b) sold a philopon of philopon of KRW 0.7g.
9) On November 10, 2017, the Defendant parked in the “O” office located in the Yeongdeungpo-gu Seoul Metropolitan Government N and in the vicinity of the above office, Qu AD car, and the same Gu R and S.
