Punishment of the crime
[Criminal Power] On April 3, 2019, the Defendant was sentenced to five years of imprisonment for fraud, etc. at the Seoul Central District Court on April 3, 2019, and the judgment became final and conclusive on October 5, 2019 and is currently being executed in the Seoul Southern Prison.
【Criminal Facts】
1. On May 26, 2015, the Defendant: (a) at the Office of Licensed Real Estate Agent C located in Jung-gu Seoul Metropolitan Government, the Defendant: (b) did not have been authorized by D to enter into a high lease agreement with the highest lease deposit, not in the form of monthly rent; (c) did not have been granted the right of representation for the lease agreement in the form of rent; (d) had, without authority, E enter into the name column of the delegating, “D”, “F”, and “Seoul, Jung-gu,” and printed it into the name column of the delegating; (d) affixed the seal of D in the name of “D” and affixed it to the name of the delegating; and (d) exercised the right of representation in the name of the delegating, a private document, which is a private document, forged; and (e) exercised the forged document as if the lessee had been duly formed with h without knowledge of the forgery.
2. On March 4, 2017, the Defendant: (a) around March 4, 2017, at the office of the above Licensed Real Estate Agent C; (b) did not have been authorized by D to enter into a high lease agreement with a high lease deposit, not in the form of monthly rent; (c) did so as if D granted the power of representation for a lease agreement in the form of rent; (d) had a licensed real estate agent E, without authority, enter into the name column of the delegating, “D”, “F”, and “Seoul Jung-gu G”, into the name column of the delegating, and printed out the name of the delegating, “D”, “D”, “B” and “B”, without authority; and (d) forged a letter of delegation under the name of D, which is a private document on rights and obligations, and forged the forged document.
