Reasons
Punishment of the crime
1. On August 24, 2010, Defendant A purchased a total of 86 insurance companies, including the victim Hyundai Marine Fire Insurance Co., Ltd., Ltd., “Undividend PPP,” “Non-Distribution Stick Raf,” “Non-Distribution Blof,” “Non-Distribution Blof,” “Co., Ltd., the victim’s Murz and Marine Insurance Co., Ltd., “Non-Distribution Alfluf, Elof, etc.,” “ non-Distribution Alflus Security Insurance (Securities Number F),” “Family Lof, Co.,,, Ltd., the victim’s interest country fire and Marine Insurance Co., Ltd., “Family Lof, Co.,, Ltd., Ltd., Ltd., Ltd., “NEW flost 109,” and “NEW flost 109” around September 17, 2010.
From September 29, 2010 to October 2, 2010 of the same year, the Defendant hospitalized the H Hospital located in Gwangju Northern-gu with “sprinks, sprinks, sprinks, salteds, and tensions at the H Hospital located in Gwangju North-gu.”
However, in fact, the defendant was not in need of long-term hospitalization, did not properly treat the illness corresponding to the illness during the period of hospitalization, and even if he was not hospitalized for a long time, the symptoms were insignificant as long as it does not interfere with daily life.
Nevertheless, around October 20, 2010, the Defendant filed a written confirmation of entry and discharge with the victim Hyundai Marine Fire Insurance Co., Ltd. to the effect that “the Defendant was hospitalized for 14 days normally at the above hospital” and filed a claim for insurance proceeds, and the Defendant received KRW 420,000 insurance proceeds from the above company around October 21, 2010, and received KRW 420,000 from the above company around September 29, 2010, and received KRW 64,96,679, total insurance proceeds from the above insurance company from September 29, 2010 to April 5, 2013, as shown in the list of crimes (1) in attached Table (1).
2. Defendant B: (a) around June 3, 2010, the victim Hyundai Marine Fire Insurance Co., Ltd.; (b) did not pay dividends.
