1. The defendant shall be the plaintiff.

가. 원고는 2009. 1. 7. 인천시 부평구 B에 있는 C역 맞이방 내 별지 도면 표시 ①, ②, ③, ④, ①의 각 점을 순차 연결한 선내 ㈎부분 점포 8.75㎡(이하 ‘이 사건 점포’라 한다)에 대하여 피고와 전문점운영계약(이하 ‘이 사건 계약’이라 한다)을 체결한 후 매년 갱신계약을 체결해왔고, 피고는 이 사건 계약에 따라 이 사건 점포를 점유ㆍ사용하여 왔다.

B. The main contents of the instant contract are as follows.
