1. Facts of recognition;

A. On December 24, 2008, the Plaintiff entered into a contract for specialized store operation (hereinafter “instant contract for specialized store operation”) with the Defendant, setting a contract term of one year with respect to the attached drawings 1, 2, 3, 4, 7.5 square meters of stores on board (A) and (4), 7.5 square meters of stores on board (hereinafter “instant store”).

Since then, by concluding an annual renewal contract, the period was extended by December 31, 2013, and again, the period of the contract was extended by June 30, 2014 by concluding an interim revision contract for a specialized store on three occasions.

(Provided, however, even during the contract period, the above revised contract was terminated even during the period of the plaintiff's request, and the store name also returned by the designated date). (B)

The main contents of the instant specialized store operation agreement are as follows.

Article 22 (Contract Period) (1) The basic contract period of a railroad station store shall apply to the investment expenses computed by calculating the investment expenses by aggregating the investment expenses for each business zone.

Provided, That the maximum operating period for each store shall be one year at the time of renewal, and the maximum operating period for each store shall be the last day of the month of conclusion of the contract which has passed three years (five years) after the year including the date

Article 25 (Management of Sales and Payment of Sales Proceeds) (6) The defendant shall deposit the sales proceeds on the day into the account of the relevant headquarters of the plaintiff or the financial institution designated at the relevant headquarters of the plaintiff during the next morning, and the time of settlement of daily sales shall be the last day of each month.

The monthly minimum sales amount: Article 26 (General Cost) (11,000,000 won per month (including value added tax) ① The plaintiff shall pay 75% of the monthly sales (including value added tax) to the defendant as a comprehensive cost.

Article 41 (Return and Restoration of Burial) (1) Where the contract is terminated due to termination of the contract, expiration of the contract period, etc., the defendant shall return the store within the designated date, and remove the facilities, etc. installed by the defendant in the store.
