1. The Defendant: (a) KRW 115,971,652 for the Plaintiff and KRW 5% per annum from July 21, 2017 to August 29, 2018; and (b) August 30, 2018.
Reasons
1. Facts of recognition;
A. C Co., Ltd. (hereinafter “C”) whose representative is the Plaintiff owned 75.73/1/538 of the land for factory in Daegu-gu, Daegu-gu, and a factory building on its ground (hereinafter “each of the instant real estate”). However, C’s creditor purchased each of the instant real estate in the name of the Defendant and G (Seoul District CourtF) on February 25, 2016 from the voluntary auction procedure (hereinafter “E”) upon the application of the Securities and Exchange Co., Ltd. (hereinafter “E”), and completed the registration of ownership transfer in the name of the Defendant and G on the same day.
B. As above, the Plaintiff procured KRW 400,000,000 from G and its own money of KRW 80,000,000 from the Defendant, and KRW 120,000,000 from the Defendant in order to pay the sales price of each of the instant real estate. The remainder KRW 1,00,000,000 from E was loaned from E.
