1. The Defendant points out each of the annexed drawings No. 1, 2, 3, 4 and 1 among the annexed drawings No. 226§³ in Nam-gu, Gwangju, Nam-gu, Gwangju, with the Plaintiff.

1. Facts of recognition;

A. On July 31, 1998, the Defendant entered into a lease contract with the following terms: (a) on a rent of KRW 1.5 million per annum; (b) 12 months; and (c) a special agreement with the Nam-gu Seoul Special Metropolitan City (hereinafter “instant land”); (d) the lessee shall be deemed to be the lessee to be the subject of restoration; (e) all residues shall be the subject of disposal; and (e) in case of a re-contract, the lease contract shall be the subject of consultation one month prior to maturity; and (e) on July 31, 200, the lease contract was renewed with the same content; and (e) thereafter, the rent of KRW 1.8 million per annum with the renewal of the lease contract on the same condition on several occasions.

B. On October 21, 1992, E purchased the instant building and obstacles located on the instant land at KRW 5,000,000 from E on August 19, 198. The Defendant purchased the instant building and the instant land at KRW 5,00,00.

C. D deceased, and on November 20, 2015, the Plaintiff acquired ownership on the instant land due to inheritance by agreement and division.

On October 1, 2015, the Plaintiff notified the Defendant of the termination of the lease agreement with respect to the instant land upon the expiration of the lease agreement term, and the Defendant paid a rent around October 2014, which was unpaid for the year 2015.

마. 현재 이 사건 토지 상에는 별지 도면 표시 ㄱ, ㄴ, ㄷ, ㄹ, ㄱ의 각 점을 차례로 연결한 선내 (가)부분 18㎡ 컨테이너 박스, ㅁ, ㅂ, ㅅ, ㅇ, ㅈ, ㅊ, ㅋ, ㅌ, ㅍ, ㄷ, ㅁ의 각 점을 차례로 연결한 선내 (나)부분 82㎡ 하우스 건물 및 ㅇ, ㅎ, ㄱ1, ㄴ1, ㄷ1, ㅊ, ㅈ, ㅇ의 각 점을 차례로 연결한 선내 (다)부분 49㎡ 슬레트건물 및 부속사 건물이 존재하는데, 그 중 이 사건 건물 부분을 제외하고는 모두 불법건축물이다.
