1. Facts of recognition;

A. The Plaintiffs shared 1/2 shares of approximately 380 square meters in Jeonnam-gun D (hereinafter “instant D”) with a total of 1/2 shares, and the Defendant owned approximately 354 square meters in Jeonnam-gun E (hereinafter “instant E”).

다. 원고들은 이 사건 E 토지 중 별지 도면 표시 ㄱ, ㄴ, ㄷ, ㄹ, ㅁ, ㄱ의 각 점을 순차로 연결한 선내 ㈎부분 10㎡ 지상에 창고, 같은 도면 표시 ㅊ, ㅋ, ㅌ, ㅍ, ㅎ, ㄱ', ㅊ의 각 점을 순차로 연결한 선내 ㈐부분 30㎡ 지상에 화단을 설치하여 위 토지를 점유하고 있다. 라.

A의 부친인 망 F이 이 사건 D 토지에 신축하여 1961. 5. 23. 보존등기한 목조 기와지붕 단층 주택 83.7㎡를 원고 A과 그 아들인 원고 B이 1991. 3. 10. 증여받아 각 1/2의 지분으로 공유하여 현재까지 계속하여 점유해 오고 있는데, 위 주택의 일부 처마가 이 사건 E 토지 중 별지 도면 표시 ㄷ, ㅈ, ㅇ, ㅅ, ㅂ, ㄹ, ㄷ의 각 점을 순차로 연결한 선내 ㈏부분 7㎡ 이하, '이 사건 E 토지 중 ㈏부분'이라 한다
