A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

Defendant

On November 9, 2012, B, C, D, E, and F: (a) intended to invite the buyers of the private horse tickets to purchase the private horse tickets at a non-permanent place and deliver them to the Center with the request for purchase of the private horse tickets; and (b) solicited to play a role of “rawling” in the name of settling dividends according to the results of racing; (c) B, including customer management, share the roles of “rawlling” in which the Defendant pays dividends, etc. to customers; (d) the Defendant, F, and E, the role of receiving orders from customers who want to purchase the private horse tickets; and (d) C, on the basis of the main text of the phone, share the roles of the management of customers and the management of the distribution board.

On November 9, 2012, Defendant B, C, D, E, and F, according to the above public offering, viewed a horse racing program operated by the Korea Racing Association from 1208 to 15% of the horse racing in order to purchase a horse racing ticket operated by the Korea Racing Association, Defendant B, C, D, E, and F: (a) sold the horse ticket under the name of “purchase”; (b) selling the horse ticket under the name of money if the horse race is not preferred, and (c) selling the horse ticket and selling the horse ticket under the name of money if the horse is not preferred, and (d) selling the horse ticket in the manner of receiving 1 to 2% of the horse ticket from the Center as the fee if the horse was not able to purchase the horse ticket.

Accordingly, Defendant B, C, D, E, and F conspired from November 9, 2012 to November 25, 2012, in collusion, received or received private horse tickets equivalent to KRW 283,370,00 as stated in the attached Table II of crime list from November 25, 2012 as the purchase price for the racing. According to the racing result, if the customer is fit on the horse, the customer would be able to perform an act similar to the horse racing voting by receiving the price from the final center and paying it to the customer.
