A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

1. The Defendant is a person who, from August 8, 2005 to February 28, 2014, worked as a research institute for developing steel products at a company causing damage, as a company under the Unfair Competition Prevention and Trade Secret Protection Act (i.e., leakage of trade secrets), occupational breach of trust - manufacturing specifications, and process control list (the document files and cell phone photographs referred to in subparagraph 9). From around February 8, 2005 to February 28, 2014, retired the damaged company from office around February 28, 2014, and was working at the said research institute.

On February 28, 2014, the Defendant: (a) maintained in secret all information on management or technological skills useful for the business activities that he/she becomes aware of in connection with the business activities of the victimized company pursuant to the agreement on industrial property rights and confidentiality of business operations concluded with the victimized company; and (b) after retirement, has a duty to immediately return all data and copies thereof and not to use them without the company’s permission; (c) in violation of the duty; (d) after leaving the Republic of Korea or continuing to work in the business sector related to the steel surface processing system, the victimized company entered the ERP program into the file form, printed out, possible, and printed out; and (d) it falls under the business secrets of the victimized company as the combination ratio of products; and (e) after retirement, the Defendant did not enter the relevant data and copies of the company’s trade secrets in the form of the files in the form of the files; and (e) provided that the output of the mobile phone manufacturing device with the combination ratio of steel products; and (e) stated the relevant method of printing them out or printing them as is without permission.
