1. Defendant A shall be punished by imprisonment with prison labor for ten months.

However, the above punishment shall be imposed for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Defendant A and B (a public offering with the Ministry of Strategy and Finance) (hereinafter “Defendant A”) had been introduced through friendly districts, and agreed to obtain a lease loan from a financial institution after entering into a false lease contract with a lessee for an apartment with a loan to obtain a loan from a financial institution. The first priority is to pay the loan of KRW 50 million after the month when the loan is repaid with the loan in the name of the apartment sale fund. The Defendant A and B agreed to purchase an apartment bond of KRW 1 in the name of the new company. On the other hand, Defendant A entered into a false lease contract with a financial institution and cancelled the security established in the apartment loan with the financial institution, and upon the lessee’s transfer of the apartment house, the above loan will be obtained again from another financial institution as a security.”

As a result, Defendants and C made a false lease contract and offered a public recruitment in order to receive a loan from a financial institution.

Accordingly, around October 31, 2013, Defendant B borrowed KRW 100 million from the National Bank as collateral of 102 Dong 1305 and purchased the above apartment in approximately KRW 125 million according to C’s order. On November 7, 2013, Defendant B prepared a lease contract for the above apartment with the lessee as Defendant B, and the lessee was 130 million from the “N Licensed Real Estate Agent Office” located in Y in Hasan-si, Hasan-si. On November 8, 2013, Defendant A obtained the fixed date of the lease contract around November 8, 2013.

Defendant A continues on November 8, 2013 according to C’s instructions.
