A defendant shall be punished by imprisonment for three years and by a fine of fifty thousand won.

When the defendant does not pay the above fine.

Punishment of the crime

On December 12, 1983, the Defendant entered the Korea Electricity Corporation as “Class 4 B” and served as the head of the Korea Power Agency from February 15, 2007 to November 19, 2014, who is in charge of the connection construction, and from the department in charge of the connection construction, the head of the department in charge of the connection construction, and the department in charge of the handling of track information (Grade 4 A). From November 20, 2014 to November 20, the Defendant serving as the head of the Korea Power Branch D D D branch, who works as the head of the Korea Power Branch, and from around 2005 to the date, E is a person working as the head of the Korea Power Branch, a company in charge of the construction and operation of solar power infrastructure, and H is a person who is working as the head of the Korea Power Agency from January 1, 2009 to the date of its operation.

Officers and employees of the Korea Electric Power Corporation are deemed public officials in the application of Article 129 of the Criminal Act under the Act on the Management of Public Institutions.

On September 2012, the Defendant served as the head of the new power supply team of the power supply team dealing with information on solar power lines (DL) at the Korea Electric Power Corporation D branch located in I around 2012, and was in the position of exercising influence as the chairperson of the Trade Union and Labor Relations Adjustment Committee, and was introduced by the director of the G Co., Ltd. through J. of the Management Bank Co., Ltd.

On September 2012, the Defendant: (a) at the D D branch of the above Korea Electric Power Corporation, “G”, a company operating solar power plant construction business, operates solar power plant construction business; (b) through the director H of “G in charge of operating solar power plant construction business,” which requires electric power line information in return for providing convenience such as providing information; (c) requests the representative director of the company in charge of operating solar power facilities to construct a solar power plant at a price lower than the market price; and (d) requests the supply price (including value-added tax arrears) in the name of the Defendant’s wife (including value-added) 265 million won in excess of the supply price in the name of the Defendant’s wife.
