A person shall be punished by imprisonment with prison labor for not less than four months and by imprisonment for not more than six months for a crime of No. 2 as decided by the court below.

『2016 고단 1332』 [ 범죄 전력] 피고인은 경기 용인시 기흥구 D에 있는 자신의 주택에서 피고인이 관리하는 인터넷 포털 다음사이트 ‘E )에서 ‘F’ 라는 닉네임을 사용하는 사람이고, 피해자 G는 경기 남양주시 H에서 난( 蘭) 배양 비닐하우스를 운영하는 사람이며, 위 카페의 카페지기인 피고인은 같은 카페에 피해자를 비방하는 글을 작성 후 게시한 사실로 2014. 12. 10. 경 수원지방법원에서 정보통신망이용 촉진 및 정보보호 등에 관한 법률위반( 명예훼손) 죄로 징역 4월에 집행유예 2년을 선고 받고 그 판결이 같은 달 18. 경 확정되었다.

[Criminal facts]

1. The Defendant posted a text to the effect that his IDs damage the victim’s reputation by using it as above, and followed the Defendant’s wife by using the Defendant’s wife “J” to write comments to the effect that he makes the above text in concert with the Defendant’s wife.

Accordingly, on December 31, 2013, the Defendant posted comments to the effect that the Defendant slandered the victim on the same day from the above Defendant’s office to “J” on the same day, and then posted comments to the effect that “The level of politics is the same, and this change occurs to the people who grow bad in Korea.”

Nevertheless, the defendant, as seen above, posted a false letter on the victim with the ID of another person, thereby impairing the honor of the victim, and around that time, from August 2014.
