1. The defendant on September 12, 1996, with respect to the plaintiff with respect to 8,430 square meters of Gyeonggi-gun B forest land.
Reasons
1. The following facts are not disputed between the parties, or may be acknowledged by adding the whole purport of the pleadings to the entries in Gap evidence 1, evidence 2-1, evidence 2-2, evidence 3-1, and evidence 3-2.
The 8th 5th 5th Gun Forest land in Gyeonggi-do (the 8,430 square meters of current Gyeonggi-gun B forest in Gyeonggi-gun; hereinafter “instant forest”) is the land under the circumstances of Nonparty D, who had a domicile in Gyeonggi-gun C at the time of the circumstances.
B. On May 18, 1948, E, the Plaintiff’s family head, was deceased on May 18, 1948, when he had his permanent domicile in the Gyeonggi-gun F, and accordingly, H born from the F of the G Gyeonggi-gun as the head of the above E, succeeded to Australia.
He died on January 25, 1967, and accordingly, as the head of H, the J, born from the F of the I Gyeonggi-gun F, succeeded to the Australia from the above H.
The plaintiff is a child of the above J. J.
C. Meanwhile, the defendant Republic of Korea completed the registration of initial ownership of the forest of this case under its name as the 10081 receipt on September 12, 1996, by the Jung-gu District Court’s annual registry office of the Republic of Korea as to the forest of this case.
2. The judgment as to the plaintiff's claim was based on the fact that the title holder of the forest of this case was located in Gyeonggi-gun C at the time of the situation, and that the birth of the plaintiff's father H(1895) and the plaintiff's father(1917) had been F in Gyeonggi-gun F in the field of Gyeonggi-gun. The plaintiff's father's father's father's father's father's father's father's father's father's father's mother's name is the same as D, which is the title of the forest of this case, and the above "D" was not used. In light of the above fact that the plaintiff's father's father's father's father's father's father's father's father's father's father and the plaintiff's father's father's father's father's father's birth and birth year, at the time of the plaintiff's birth and birth year, the plaintiff's plaintiff's father's father's death had been residing in the Gyeonggi-gun group.
