A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Around 00:49 on March 1, 2020, the Defendant attempted to larceny a notice of “coverage repair” prepared in advance to steal cash in the cash withdrawal period located in the same number of cash withdrawal period owned by the Dispute Settlement Bank Co., Ltd., in Suwon-gu, Suwon-si, Suwon-si, which was located in the Dispute Settlement Bank D, and attempted to open the said cash withdrawal machine by putting it down in hand, and use the divers prepared in advance, but failed to do so.
2. In order to use the vehicle of the victim company, the defendant illegally uses the vehicle by driving the victim company's vehicle in the section of about 30 km from the victim company's parking lot in Suwon-gu, Suwon-si (hereinafter "victim company"), and without obtaining prior permission from the manager for the purpose of his/her business, he/she brought the key to the manager's vehicle. On February 29, 2020, the defendant started from the victim company parking lot and used the vehicle of the victim company in the section of about 30 km from March 2, 2020 to the victim company parking lot, and used the vehicle of the victim company for temporary use without the consent of the right holder.
3. At around 00:24 March 3, 2020, the Defendant cut off all of the two cash withdrawal machines installed in the victim's cash withdrawal machine located within the same scale C, set forth in paragraph (1) of this Article, in order to steal the cash withdrawal machine in the victim's cash withdrawal machine, which is located within the same scale C, and then, the Defendant forced each cash withdrawal machine to be opened by using a deadly weapons ("speed") and a draber, which was prepared in advance, and then cut off the victim's cash possession KRW 9750,00 and one hard disc in the market price.
4. The Defendant shall be located in the cash withdrawal period owned by the victim in the time and place specified in paragraph 3, as described in paragraph 3.
