The defendant shall be innocent.

1. Facts charged;

2. Determination

A. The Defendant, as indicated in the facts charged in the instant case, borrowed a sum of KRW 5 million on March 19, 2009, KRW 3 million on March 26, 2009, and KRW 10 million on May 8, 2009 (hereinafter “each of the instant loans”) from the victim to pay interest at an interest rate of 10% per month, as indicated in the instant facts charged, but he/she borrowed a sum of KRW 10 million on May 8, 2009.
