1. The plaintiffs' claims are dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. Basic facts
A. The plaintiffs are the successors and substitute successors of Q Q who were declared missing on October 5, 1989.
B. (1) On April 20, 1942, on the ground of sale and purchase on April 23, 1942, the ownership transfer registration under the name of S (S and Q’s name) was made on February 23, 194 with respect to the 1016 square meters of Gyeonggi-gun Tland, Gyeonggi-do, Gyeonggi-do, which was owned by R (hereinafter “instant 1 forest”). On April 25, 1955, the ownership transfer registration under the name of Suwon District Court’s registry office received on May 2, 1955 (hereinafter “the first ownership transfer registration”), was completed on May 2, 1955, under the name of Suwon District Court’s registry office received on May 395, 195, for the sale of the instant 1 forest in the name of Q 2,000 Won-do.
(2) Subsequent to May 10, 1960, the ownership of the forest land No. 1 in this case was transferred to Chungcheongnam-gun on May 10, 196, and was succeeded to the Defendant’s right on November 12, 1992. The forest land No. 1 in this case was changed in the name of the administrative district, divided land, merged and became the real estate No. 1 in the separate sheet as indicated below
On October 31, 2005, the change of the name of the administrative district on September 17, 2009, the change of the land category on September 10, 2009, on February 1, 201, 201, when the land category is changed on September 17, 2009, the land category of which is on February 2, 2005.
C. (1) The transfer registration of ownership in Q on April 7, 1949 was made for sale and purchase on April 7, 1949 with respect to the land No. 2281 square meters of Gyeonggi-gun AB Forest land owned by AA (hereinafter “the land No. 2”), Gyeonggi-do, Gyeonggi-do, Gyeonggi-do, the ownership of which was owned by AA, and the forest land No. 1 in this case (hereinafter “the forest of this case”), and the transfer registration in Q was made on April 25, 195 on April 25, 195, and the registration of ownership transfer in the name of Suwon Education-gu, the registration office of Suwon District Court No. 394 was received on May 2, 1955.
