A defendant shall be punished by imprisonment with prison labor for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant, around July 2017, while working as an employee at the “C Point” located in Eunpyeong-gu Seoul Metropolitan Government, had D applied for opening of a mobile phone and possessed a copy of D’s passport submitted by the Defendant. On the other hand, the Defendant was willing to open a mobile phone in the name of D using the copy of the above passport.

1. Counterfeiting of forged official documents;

A. On September 7, 2017, the Defendant applied for the opening of a mobile phone in the Eunpyeong-gu Seoul Metropolitan E Commercial Building E-F at the “G store,” and exercised a copy of D’s passport, which is a forged official document with the Defendant’s photograph attached instead of D’s photograph, as if it were a document duly formed, the Defendant issued one copy of D’s passport, which is a forged official document with the Defendant’s photograph, to H, who is aware of the forgery.

B. On September 8, 2017, the Defendant applied for the opening of a cell phone in the name of D at the same place as before, and exercised a copy of D’s passport, which is a forged official document with the Defendant’s photograph attached instead of D’s photograph, as if it were a document duly formed to H, who was aware of the forgery.

2. Forgery of private documents and the display of private documents;

A. The Defendant: (a) forged two copies of a new service contract in the name of D, which is a private document on rights and obligations, for the purpose of exercising the right and obligations; (b) forged two copies of a new service contract in the name of D, which is a private document in the name of D for the purpose of exercising the right and obligations; and (c) delivered as if the said sales store employees were the document duly formed, which is a private document in the name of D, with the intention of exercising the right and obligations, as if D applied for mobile phone membership by using a black tool on the new contract paper. Accordingly, the Defendant forged two copies of a new service contract in the name of D, which is a private document on the rights and obligations, to exercise the right and obligations. (b) The Defendant forged and uses two copies of a new service contract in the name of D, which is a private document.
