1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts (applicable for recognition: Fact that there is no dispute, Gap evidence 1 through 6, entry of evidence Nos. 4 and 5, and purport of the whole pleadings);
A. On January 8, 2016, the Plaintiff was the owner of the treatment-based B 97 Tratler (hereinafter “instant Tratler”). On January 8, 2016, the Plaintiff received improvement from the Defendant, such as the exchange of ZF Tphs, the exchange of 10T disc, the ZF’s processing and decomposition assembly, etc., and paid KRW 1,632,40,00 at its repair cost to the Defendant.
B. From January 14, 2016 to January 15, 2016, which was three days after being repaired by the Defendant, the Plaintiff paid KRW 1,314,001 in total at repair cost to C after being maintained by the instant Trarrrrrrrrrrrr’s constructive disc circulculty in the former part of the main part of the area, and after being maintained by the Madrrr’s structural cf151, Madrr’s Zf151, Madr’s Zf151, Madr, and Madr, etc., the Plaintiff paid KRW 660,00 in total at repair cost to the mining machine of the instant case.
C. On January 15, 2016, the Plaintiff stopped the engine during the shipment of the instant Trr in C, and listen to the statement that the Plaintiff caused problems to the engine of the instant Trr due to the Defendant’s fault in repair, and inspected the instant Trr around January 16, 2016 in order to inspect whether the Defendant’s fault was found in repair, the Defendant towed and inspected the instant Trr around January 16, 2016, and the Plaintiff did not err in the repair of the Defendant, and contacted the Plaintiff that the instant Trr was released.
On January 29, 2016, the Plaintiff, who was in custody of the Defendant, was towing at the expense of KRW 900,000,000,000,000,000,000,000,000. On January 30, 2016, the Plaintiff maintained the Plaintiff’s engine attachment, etc., and paid KRW 47,30,000 at the repair cost to the Bamaing Co., Ltd., Ltd., and the said repair was performed.
