A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of three years from the date this judgment becomes final and conclusive.

Punishment of the crime

Despite the fact that the Defendant is not a narcotics handler, the Defendant purchased, sold, and administered the Megatocule (the clopphone; hereinafter referred to as the “philophone”) which is a local mental medicine as follows.

1. The Defendant, together with C, conspiredd to purchase approximately KRW 0.1g of 10,000 from D with D to purchase approximately KRW 0.1g of opon. On March 4, 2016, the Defendant sent KRW 50,000 to C in the vicinity of F shopping located in Nam-gu Incheon Metropolitan City on March 4, 2016, and C purchased approximately 0.1g of oponon from D to KRW 100,00 ( KRW 50,000 of the Defendant and KRW 50,000 of KRW 30,00).

2. The Defendant purchased philophones as above, put about 0.05 g of philophones delivered by C into one-time philophones fraud, and administered them in a way of dilution with water and injection with his arms.

3. On January 13, 2017, at around 21:00, the Defendant purchased approximately KRW 0.2g 10,000 from I before H telephone 607, located in Jung-gu Incheon, Jung-gu, Incheon.

4. The Defendant, at around 21:00 on the same day, injected approximately 0.1g of philopphones purchased from the instant philopphones, into a single-use main fraud, and injected them into his arms by dilutioning them with water.

5. On January 14, 2017, at around 15:00, the Defendant administered approximately 0.1g of phiphonephones purchased from the toilet of the first floor of the K church located in the Nam-gu Incheon Metropolitan CityJ in the same manner as paragraph 3.

6. On January 30, 2017, around 03:55, the Defendant purchased approximately KRW 0.2g 100,000 from I before H telephone 607 located in Jung-gu Incheon Metropolitan City Jung-gu.

7. The Defendant, at around 04:20 on the same day, inserted approximately 0.1g of philophonephones purchased in the non-commercial rain or toilet (place as referred to in paragraph 4) near the Incheon Jung-gu Coast Guard, into a single-time drinking fraud, and administered them by dilution with water.

8. On January 31, 2017, the Defendant purchased at around 14:00, as set forth in paragraph 6, from the first floor toilet of the K church located in the Nam-gu Incheon Metropolitan CityJ.
