1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
Basic Facts
A. A. Around January 2016, the Korea Army Academy established within the Cheongju Air Force Korea Army established under the Cheongju Air Force Korea Armed Forces (hereinafter “instant first project”) and ordered a subcontract to the Plaintiff for the construction of the facilities within the Cheongju Air Force Academy (name 15-Woo-U-12A) (hereinafter “the instant first project”). Defendant Gwangju Construction entered into a subcontract for each of the instant projects (hereinafter “the instant subcontract agreement”) with the Plaintiff by setting the period for subcontracting construction among the instant first projects as KRW 22, February 22, 2016 on the date of commencement, and KRW 582,789,000 on December 24, 2016 on the date of completion, December 22, 2016; ② on the date of completion, on the date of completion, December 24, 2016; and on the date of completion, contract price 510,700,700 each of the instant projects (hereinafter “the instant subcontract agreement”).
Since then, on December 24, 2016, Defendant Mine Construction entered into a subcontract agreement with the Plaintiff on the change of the contract amount for molding works in the first subcontract of this case as of February 22, 2016, to KRW 429,840,00, and the contract amount for reinforced concrete construction as of KRW 497,80,000, respectively.
B. With respect to the construction of the building of the ASEAN Elementary School Teachers (the name of the Corporation: the New Construction of the ASEAN Elementary School Teachers) ordered by the ASEAN Elementary School Teachers’ Office of Education (hereinafter “the instant second project”), Defendant Gwangju District Co., Ltd. (hereinafter “the instant second subcontract”) concluded a subcontract with the Plaintiff on February 12, 2016 between the Plaintiff and the Plaintiff on February 13, 2016; the date of commencement; the date of completion; December 31, 2016; the contract amount of KRW 950,950,000; and the Plaintiff on December 31, 2016; and the contract amount of KRW 950,950,00 among the instant second projects (hereinafter “instant second subcontract”).
C. With respect to the “National Highway Improvement Project” ordered by the Chungcheong Land Management Office of the Dogdo 38 National Highway (hereinafter “instant third Project”), Defendant SB (hereinafter “instant third Project”), the Plaintiff.
