All appeals filed by A and prosecutor are dismissed.
Reasons
1. Reasons for appeal;
A. Defendant A’s punishment is heavy.
B. The lower court’s sentence against the Defendants on the prosecutor is somewhat weak.
2. The Defendant A deposited one million won for the victim I.
In addition, there is no significant change in circumstances to consider the sentencing of the Defendants after the judgment of the court below.
In light of all the circumstances asserted as the grounds of appeal by Defendant A and the prosecutor, the lower court’s punishment against the Defendants cannot be deemed as heavy or minor, even if it is considered that the lower court’s punishment is heavy or light.
3. Conclusion, Defendant A and Prosecutor’s appeal cannot be accepted in entirety.
