[2013 Highest 2441] Defendant A and B conspired to sell them via transit by mixing them with light oil and light oil, and the same year from June 27, 201

Until January 1, 200, Defendant A actually operated “SK G gas station” by Defendant A located in Namyang-si, and Defendant A was in charge of the order and supply of petroleum while operating the above gas station. Defendant B manufactured pseudo petroleum products by means of inserting light oil in a light tank with the instructions of Defendant A while working as an employee at the above gas station, and then selling pseudo petroleum products in an amount equivalent to KRW 453,550,000 during the above period.
[2014 Highest 387] Defendant A was issued a certificate of registration for petroleum retail business that sells only diesel and gasoline except for light oil, with the trade name of “J G gas station of a stock company” located in Namyang-si, Namyang-si.
1. Although Defendant A was issued a certificate of registration for petroleum retail business that is able to sell diesel and gasoline as above, Defendant A purchased 2,00 liters around July 12, 2013 in order to sell fake petroleum products and make unfair profits and kept them in a tank glass vehicle (K), which is a mobile-sale vehicle (K). From the above date and time to July 13, 2013, Defendant A manufactured 10% of the light oil storage tank installed in the above gas station and injected it into 2 at least 10% of the light oil storage tank, including light oil and 90% of the light oil storage tank, and 20% of the light oil and 80% of the light oil and 20% of the light oil, which is a fake petroleum product, in a manner that keeps them in custody.
2. On July 13, 2013, from around 14:00 to 17:50 the same day, Defendant A sold fake petroleum products to customers in a manner that would be harmful to the market price of fake transit manufactured as above, which is equivalent to KRW 1,049,326.
