1. Defendant A is a person who resides in a commercial building in the 204th City E-si building by remodeling it in a residential form;

A은 2014. 10. 3. 14:10 경 위 E 상가 건물 입구에서, 그 무렵 상가 건물 앞에 또 다시 5 일장이 섰다는 이유로 화가 나, 건물 내부 계단에 행인들이 방뇨를 하여 물 청소를 해야 하는데 청소를 한 물이 건물 밖으로 흘러내려가 보도 블럭 사이까지 스며 들어갔으니 보도 블럭까지 물 청소를 해야 한다는 핑계로 노점 상인들의 업무를 방해하기로 마음먹고, 건물 화장실 수도 꼭지에 호스를 연결하여 호스와 양동이를 건물 입구까지 들고 나온 뒤, 위 건물 앞에서 고구마, 호박, 깻잎, 콩, 배추 등을 판매 목적으로 좌판에 진열해 놓고 있던 노점 상인 피해자 F, G, H 와 그들이 진열해 놓은 상품들을 향해 물을 뿌려 좌판 등이 물에 젖게 하고, 진열대 주변에 물이 잔뜩 고이게 하고, 장을 보러 온 행인들을 향해 물을 뿌려 피해자들에게 접근하지 못하게 하는 등 약 1 시간 5분 동안 소란을 피웠다.
