A defendant shall be punished by imprisonment for six months.

Punishment of the crime

On June 4, 2015, the Defendant was sentenced to 2 years of imprisonment and 600 million won of fine due to the violation of the Act on Aggravated Punishment, etc. of Specific Crimes (tax) in the resident support for the Daegu District Court on June 4, 2015, and the Defendant and the Prosecutor’s appeal are currently pending in the appellate trial.

From October 1, 2011, the Defendant is a person who operated a gas station with the trade name “C” from door-si to door-si.

1. Any petroleum retailer in violation of the Petroleum and Petroleum Substitute Fuel Business Act shall be prohibited from selling petroleum, such as petroleum, secondary fuel oil, bio-fuel oil, bio-carbon, solvent, lubrication, base oil, light oil for ships, and petroleum intermediate products as fuel for automobiles, vehicles, and machinery;

Nevertheless, from October 13, 201 to December 23 of the same month, the Defendant sold 132,185,358 won in total to freight drivers who are not able to know as customers in the above gas station, including selling light oil to freight drivers, for which the name of which is unknown as described in attached Table No. 132,185,358 won cannot be known, as in the table of crime No. 1, for the same period.

2. No person who violates the Specialized Credit Financial Business Act shall make a credit card transaction in excess of the actual amount of sales of goods or provision of services, etc. or make another person make a loan by proxy;

Nevertheless, the Defendant, from October 13, 201 to December 24, 2012, is a credit card of the freight driver, who pretends to sell oil in total amount of KRW 599,170,000, as stated in the attached Table List of Crimes, by pretending to sell the freight driver’s credit card for the same period, including the fact that: (a) the freight driver, who was unable to know the name of the customer at the above gas station from October 13, 201 to December 24, 201, pretended to provide the oil to the freight driver without actually providing the oil; and (b) paid the remaining money to the freight driver in cash.
