A defendant shall be punished by imprisonment with prison labor for up to six months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
(b) Crime history (2015 high group 2060);
1. The Defendant: (a) obtained private document forgery through Internet hosting at the request of B to purchase a mobile phone; and (b) obtained a resident registration certificate; and (c) used B’s mobile phone purchase to open an additional cell phone;
A. On April 15, 2013, the Defendant, a mobile phone sales agent in Dongjak-gu Seoul Metropolitan Government, entered “B”, “E”, “E”, and “E” in the name of customer information column for application for subscription of a new contract for the SK Telecom Services, using a computer installed therein, which is a mobile phone sales agent in Dongjak-gu Seoul Metropolitan Government, and printed out a new contract for the services, and then signed B by entering the name of “E” and “E” in the resident registration number column, “**********” in the address column, and signing on the next.
Accordingly, for the purpose of uttering, the Defendant forged one copy of the mobile phone service contract in the name of private document B, which is a private document on rights and obligations.
B. Around May 15, 2013, the Defendant entered “B”, “E”, and “B” in the resident registration number column and address column in the “E” and “E” column and signed B on the name side of the customer information subject to the application of KT mobile phone from the above “D”.
Accordingly, for the purpose of uttering, the Defendant forged an application form for mobile phone membership in the name of private document B, which is a private document on rights and obligations.
2. Exercising the relevant investigation document;
A. The Defendant submitted a forged mobile phone service new contract, such as Paragraph 1(a) at the same time and at a place as Paragraph 1(a) to an employee of a non-name-free radio operator who was unaware of the fact, by printing and inputting it into a computer program.
B. The Defendant, at the same time and place as Paragraph 1(b)(1)(b), submitted a forged mobile phone entry application to an employee of the name-free telecommunications company who was unaware of the fact by sleeping and inputting it into a computer program.
