A person shall be punished by imprisonment with prison labor for one year, and imprisonment with prison labor for a crime of No. 1 and No. 2 as set forth in the judgment of the defendant.

Punishment of the crime

On December 13, 2018, the Defendant was sentenced to six months of imprisonment with prison labor at the Suwon District Court for fraud, etc., and the judgment was finalized on December 21, 2018, and the execution of the sentence was terminated on December 17, 2018.

A. At around 07:10 on March 9, 2019, the Defendant: (a) obtained one credit card card from a national bank in the name of the injured party D and returned it to the injured party on the front side of the road located in Ansan-si, Ansan-si; and (b) did not take necessary procedures, such as returning it to the injured party.

Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.

B. On March 9, 2019, at around 07:37, 2019, the Defendant purchased DNA tobacco 1 A from the victim F operated by Ansan-si E (hereinafter omitted) on March 9, 2019, and deceiving the victim by presenting the victim as if he had the right to use the credit card lost by D as described in paragraph (1). In other words, by inducing the victim to pay the said amount of KRW 4,100 by the said credit card, the Defendant acquired economic benefits equivalent to the said amount, and used the said D lost credit card. 2) At around 08:00 on the same day, the Defendant purchased one beer at the I convenience store operated by the victim H of Ansan-si, Ansan-si (hereinafter omitted), and acquired the said credit card loss by deceiving the victim with the right to use the said credit card as stated in paragraph (1) as if he had legitimate right to use the credit card, thereby inducing the victim to use the said amount of 10:10 of property gains from the said credit card.

3) At around 08:06 on the same day, the Defendant purchased yellow cans at L convenience stores operated by the Dong-gu J (hereinafter omitted) in Ansan-si, Ansan-si, and lost D as described in paragraph (1).
