Defendant
A Imprisonment with prison labor of one year and six months, and Defendant B shall be punished by imprisonment with prison labor of one year.
However, as to Defendant B, this shall not apply.
Reasons
Punishment of the crime
1. Defendant B and D’s joint criminal conduct: (a) around 01:00 on December 20, 2014, Defendant B and D moved to a warehouse managed by the victim G located in F at the time of regular Eup/Myeon, and (b) Defendant B reported the network within the said case (K)-5 car; and (c) D entered the said warehouse through the open entrance of the said warehouse, and loaded 40 kgs of the market value of the victim’s 6.30,000 won with rice and waiting in advance to the above case (K)-5 car.
As a result, Defendant B and D stolen the victim's property together.
2. On December 27, 2014, Defendant A, Defendant A, and D moved to a warehouse managed by the victim J of HA (YF) from around 01:00 to around 02:00 on December 27, 2014, and entered the said warehouse via the open entrance of the said warehouse, and carried 40 km of KRW 90,000 of the market price of the victim’s possession into the said warehouse.
Defendant
A and D have stolen rice worth KRW 3,415,00 from around that time to four times in total as shown in the list of crimes in attached Table 1, both of which are stored in rice warehouses located in Jung-Eup under the above several methods.
As a result, Defendant A and D stolen the victim's property together.
3. The co-principal offenders A and D between the Defendants and D are co-principal offenders A and D, and Defendant B and D are co-principal offenders.
Defendant
B, while living together with D, it was intended to steal and sell rice in order to liquidate their personal harm. D proposed that this plan should be reported to Defendant A, the military unit, and that Defendant A had committed the same crime. Defendant A consented thereto, and Defendants and D conspired in order to steals with the rice stored in the rice warehouse located in the front, front, and vice versa.
