피고인은 2014. 6. 18. 22:00경 대구 수성구 B에 있는 'C' 인테리어 사무실 앞에서 경찰관 2명과 행인들이 지켜보는 가운데 피해자 D에게 “신고는 왜 했냐. 개새끼야. 야이 십새끼야. 내가 니 같은 자식이 있다. 개새끼야. 내가 생각이 안 나서 이정도지 더 심한 욕이 생각나면 더한다. 좃 같은 새끼야”라고 큰 소리로 욕을 하여 공연히 피해자를 모욕하였다.
