Reasons
Punishment of the crime
[Criminal Power] On October 22, 2010, the Defendant was sentenced to imprisonment with prison labor for a violation of the Narcotics Control Act at the Seoul Central District Court on two years and six months, and completed the execution of the sentence on October 15, 2012.
【Criminal Facts】
The Defendant, who is not a person handling narcotics, was prohibited from dealing with psychotropic drugs, such as clickphones (i.e., a single-name clopphones; hereinafter “copphones”), but dealt with the following copphones:
1. Sale and purchase of phiphones;
A. At around 12:30 on January 5, 2013, the Defendant: (a) parked in the Defendant’s passenger car located in the area near the Goyang-gu Busan High School, Manyang-si; (b) sold 1-time injection equipment with approximately 0.3g of philopon to D; and (c) 350,000 philopon.
B. At around 14:00 on February 28, 2013, the Defendant: (a) parked in front of the F Hospital located in E at the Government-si of Speaker; (b) sold a single philopon with D, which contains approximately 0.1g of philopon; (c) 50,000 won.
2. On April 8, 2013, the Defendant administered a philophone medication by inserting approximately 0.03gopon into a single-use injection machine at the Defendant’s residence in Gwangju-si, Gwangju-si, and 406gopon into a single-use injection machine, and melting the Defendant’s arms.
3. On April 8, 2013, the Defendant promised to sell Hailphones to H at the restaurant near the Dandong bus terminal in Gwangju-si, Gwangju-si, as “H, on April 10, 2013, selling 5 gramphones to H at the rest area of the middle Highway I at KRW 2 million.” On April 10, 2013, the Defendant promised that “I have a coffee shop within the I convenience store, and only Iman.” On the same day, around 13:10 on the same day, the Defendant stopped from 10 meters in front of a passenger car with a driver’s license, and on the same day, at around 13:40 on the same day, the Defendant stopped from “I’n convenience shop within the I’n expressway.”
