A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2017. 3. 1. 18:00 경 혈 중 알코올 농도 0.229% 의 술에 취해 정상적인 운전이 곤란한 상태에서 B 테라 칸 승용차를 운전 하여 전주시 덕진구 견 훤 로 336 북 일 초등학교 앞 도로를 안골 사거리 방면에서 명주 골 사거리 방면으로 편도 2 차로 중 1 차로를 따라 진행하다가, 같은 차로를 앞서 가 던 도중 차량 정체로 인해 일시 정차하고 있던 피해자 C 운전의 D 토요 타 승용차 뒷 범퍼 부분을 피고인 차량 앞 범퍼 부분으로 들이받아 그 충격으로 위 피해자에게 약 2 주간의 치료를 요하는 급성 요추 부 염 좌상 등을 입게 하였다.

In addition, the Defendant was driving under the influence of alcohol as above.

Taking into account various circumstances, such as the defendant's age and occupation, living environment, alcohol concentration while driving distance at the time of crackdown, degree of damage to the victim, circumstance of the case, etc., when agreement is reached between the victim and the reason of sentencing under Article 62-2 of the Criminal Act and the victim's comprehensive insurance; the defendant was subject to a fine once due to driving of alcohol;
