피고인은 2014. 11. 16. 01:14경 경기 양주시 B에 있는 C 운영의 D주점에서, 술값지불을 거부하며 소란을 피우다가 신고를 받고 출동한 양주경찰서 E지구대 소속 경장인 피해자 F(28세), 같은 소속 경장인 피해자 G(29세)으로부터 술값을 지불하라는 말을 듣게 되자, 위 C 등이 듣고 있는 가운데 피해자들에게 “좆같은 새끼들”, “경찰관 다 난도질 해 버리겠다. 개새끼들아. 총으로 다 쏴 죽여 버리겠다”는 등으로 고함을 쳤다.
