A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

"2017 Highest 2406"

1. On November 30, 2016, the Defendant is expected to receive a successful bid from the public service center of the Daegu District Court located in Daegu Suwon-gu, Daegu-gu, 364 on November 30, 2016, and the victim C, “No. 101 Dong 1105, Dong 1105, Dong 1105, Dong-si, Busan-si, as an object of auction.

In order to make a tender, 10% of the predetermined amount of the tender shall be paid as a security deposit.

As the bid amount would be KRW 50 million, it would be the same as the bid amount would be KRW 50 million, it would be false that the deposit would be KRW 5 million.

However, the above D Apartment No. 101,105 was not subject to auction, so even if the victim received money from the injured party, there was no intention or ability to cause the injured party to win the bid of D Apartment No. 101, 1105.

As such, the Defendant, by deceiving the victim, received one copy of the KRW 5 million check from the victim, and subsequently acquired it by deceptioning the victim a total of KRW 40,50,000,000 from March 7, 2017, as shown in the List of Crimes (1) from March 7, 2017.

2. The Defendant forged official document: (a) written “certificate of receipt”, “No. 101 Dong-dong 1105, 105, and “No. 5,000,000,” using a computer at the time, location, and place described in paragraph 1; and (b) written “No. 30,000,000,” and written “No. 30, 2016, the executive officer E in the Daegu District Court’s office,” and affix a Daegu court seal next to E.

Accordingly, the Defendant forged a receipt of a bid bond under the name of execution officer E, which is an official document.

3. The Defendant, at the time, and at the place specified in paragraph 1, presented to C, who is aware of the forgery, a receipt of an auction bond receipt, which is a forged official document, as described in the foregoing paragraph 2, was presented as a document issued.

"2017 Highest 2671"

1. On January 19, 2017, the Defendant: (a) phone calls from the victim F (n, 44 years of age) at an infinite place; (b) “The 106-dong No. 1202, 1202, 3200,000 KRW 12 billion in the Daegu G G was reported at two times.”
