[Defendant A] The defendant shall be punished by imprisonment for one year.

However, the above sentence shall be executed for two years from the date of the final judgment.

Punishment of the crime

[Criminal Power] (Defendant B) On March 8, 2018, the Busan District Court sentenced Defendant B to imprisonment with prison labor for a violation of the Act on the Control of Narcotics, Etc. (fence) and completed the execution of the above punishment on July 30, 2019.

【Criminal Facts】

1. Notwithstanding the fact that Defendant A is not a narcotics handler, the Defendant treated psychotropic drugs, psychotropic drugs, Mesophacopon (one philopon; hereinafter “philopon”) and marijuana as follows:

On June 23, 2019, the Defendant, on June 23, 2019, remitted KRW 10,50,000 to the Agricultural Cooperative account under the name of D, which was known by the winners of the names using the telegram “C”, and purchased a box containing approximately 1g of the philopon, which was sent by the winners of the above name at the Fable Cargo Storage Storage Station located in Busan Fable District E on the same day.

(2) On July 5, 2019, the Defendant, on July 5, 2019, remitted KRW 700,000 to the Agricultural Cooperative account in the above name D, and on the same day, purchased a box containing approximately KRW 1g of philopon, sent by the said person in a depository room for Fable Cargo on the same day.

(3) On September 2019, the Defendant: (a) transferred 600,000 won to an indeterminate account known by the winners of the above-mentioned name in light of the end of September 2019; and (b) purchased a box containing approximately 1g of philopon, sent by the said holders of the above-mentioned name in the Fable Cargo Depository on the same day.

B. (1) On June 2019, the Defendant administered a scopon medication by means of pressing approximately 0.05 g from among scopphones purchased, such as “A(1)”, on the part of the Defendant, at the Haman Gel located near Busan Jin Station, on June 2019, the Defendant administered the scopon medication in a way that scopon 0.05 g from among scopphones purchased as “A(1).”

(2) On July 6, 2019, the Defendant committed the crime at around July 6, 2019 by inserting approximately 0.1g of the penphones purchased, such as “A-B”, into an injection machine, and inserting them into an resistance.
