Defendant
A is the actual operator of Defendant B Co., Ltd. (the 6th floor of the E building; hereinafter referred to as “D”) and Defendant C Co., Ltd. (the 6th floor of the E building; hereinafter referred to as “C”) who are engaged in the work of civil engineering and construction, etc., with the interest of the representative director of the E Co., Ltd. (the 6th floor of the E Co., Ltd.; hereinafter referred to as “B”), and the said 3 companies are all the above 6th office units of the E Co., Ltd. and are integrated into the work management division, accounting division, civil engineering division, and construction division, and have overall control over the above 3 companies related to the construction business in B, without distinguishing them from each other.
1. The Defendant: (a) at Fdo, G City, and H Si, etc., the Civil Works Corporation B and C for each type of business that is capable of bidding among the three companies, such as B, to obtain a successful bid in the relevant electronic bid, such as the harbor construction project ordered through the National Integrated Electronic Procurement System (hereinafter “National Procurement System”); and (b) the steel reinforced concrete construction project is even even with C and D; (c) the amount of bid bid among the companies (e.g., examples, bid amount (89,061,175 won) = Basic Amount (10,000,000) ¡¿ (0.) x (0745) x (1.05) x (1.05) x (1.05) x (1.05) x the rate of successful bid by making a mutual consultation between the companies dealing with the same bidding.
Accordingly, when the electronic bid “J Corporation (Public Notice No. K)” ordered by Fdo (I) on May 1, 2014 was publicly announced at the national market, the Defendant ordered L, C’s tender officer M, D’s tender officer, and D’s tender officer on May 9, 2014 and ordered N on May 9, 2014, at around 08:45 and around 09:16, A. B and C’s office of the 6th floor management department of the building in the above E E-building (IP) to jointly reflect the bid price in the name of B and C at KRW 308,461,00 and KRW 308,058,00,000, respectively, and the bid price probability is higher than twice.
