A defendant shall be punished by imprisonment with prison labor for up to six months.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The defendant of "2018 Highest 708" is a Chinese national's shipbuilding, and a person who enters the Republic of Korea on January 20, 2018 and stays in the Republic of Korea without a fixed residence and occupation.
1. On February 27, 2018, the Defendant: (a) around February 27, 2018, on the roads in front of the Dong-dong mayor located in Dongdaemun-gu Seoul, Dongdaemun-gu, Seoul; (b) there is no intent or ability to pay taxi charges; (c) when arriving at a destination after boarding the E-si located in the victim D Operation, the Defendant would have the victim would pay taxi charges; and (d) around 04:35 of the same day, the Defendant had the victim drive the said taxi up to the G E-ray road located in Daejeon Seo-gu, Daejeon-gu F.
Accordingly, the defendant, by deceiving the victim, acquired pecuniary benefits equivalent to 181,120 won of taxi fees.
