On the other hand, the defendants are those who purchased specific parts from M in the above way, or those who subsequently purchased a pre-sale and completed the registration of transfer of shares.

According to the above facts of recognition, the part occupied and used by the Plaintiff is owned by the Plaintiff and the registration of shares in the Defendants’ names is based on mutual title trust. Therefore, the Defendants are obliged to implement the registration procedure for ownership transfer for reasons of termination of title trust on the date of delivery of a copy of the instant complaint to the Plaintiff.
