1. The plaintiff's claims against the defendants are all dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. The Plaintiff is an insurer who has concluded a contract for non-distribution franchise security insurance (fire insurance) with respect to a non-distribution franchise insurance (fire insurance) with respect to a 17 November 17, 2011 to November 17, 2014 with respect to a 1st floor C store and 6th floor clothes warehouse A and vice-si B.

B. On January 30, 2014, at around 13:09, D, an employee of the said store, caused a fire in the course of explosion by a portable gas contact container installed in the said gas burner (hereinafter “instant gas container”) while cooking food by using a portable gas burner (hereinafter “instant gas burner”).

(2) On March 18, 2014, the Plaintiff paid KRW 113,608,000 as insurance money to A with respect to damage incurred by the instant fire, as an insurer of A. The Plaintiff paid KRW 113,608,000 to A.

C. Summary of the comprehensive fire investigation report by the competent fire station is as follows:

(1) 발화 지점 및 연소 확대 경로 - D은 닭볶음탕을 1차 끓이고 나서 2차로 끓이던 중 가스를 교체하였고, 교체한 후 약 15-20분 정도 지나서 폭발하였다고 진술함. (2) 화재 원인 검토 (가) 가스 누출 관련 - 이 사건 가스 용기 부분에 2군데 이상점(비파괴 검사 사진에서 다른 부분에 비하여 매끄럽지 못한 부분) 관찰되고, 이 사건 가스 버너는 이 사건 가스 용기와의 결착 부분에 이상점 관찰됨. - 이 사건 가스 용기의 가스 분출 압력이 5-7kg 이상이면 이 사건 가스 버너의 안전 스위치 즉 가스 용기의 결찰 레버가 오프 상태로 돌아가야 하나 완전하게 원 위치로 복귀되지 않은 상태임. - 이 사건 가스 용기의 내부 압력이 13kg 이상이면 용기의 상부 캡 부분의 주름이 팽창하고, 15kg 이상의 압력이 발생하면 가스 용기의 상하 부분이 분리되는 구조임. - 폐쇄 회로 확인, 현장의 잔류된 상태, 휴대용 가스 용기의 위치, 파열 상태, 비파괴 촬영에서...
