1. The Plaintiff (Counterclaim Defendant) against the Defendant (Counterclaim Plaintiff)
(a) KRW 24,114,442 and this shall be from June 5, 2013 to November 2013.
Reasons
1. Facts which have no dispute over the facts of recognition [Evidence], entries in A5, 1-1 through 3, 2, 5-1 through 4, 5-3, 9-1 through 3, 10-1 and 2, 11-1 through 4, and the purport of the whole pleadings;
A. The Plaintiff is a business entity that manufactures and sells plastic withdrawn, and the Defendant is a business entity that manufactures and sells the direction agents. The Plaintiff made, around March 2007, a 100g direction container, a 200g direction container from around December 2007, and a bold container from around April 2008, the Plaintiff made, in order with the Defendant, a container for the delivery of containers, and manufactured and supplied the above containers to the Defendant, but entered into a container supply contract with the Defendant on the detailed method of paying gold and container prices (hereinafter “the container supply contract of this case”).
(1) The gold-type price for each container shall be determined as KRW 9,00,000 without distinction between the type and capacity of the container; the gold-type price shall be paid in 9,00,000,000, 50,000,000,000,000 for each container; and 65.5,000,000,000 for each container shall be paid in addition to the unit price for each container for each container.
(2) The unit price for the 100g direction container: the unit price for the 100g direction container for the 200g direction container: 226 won from December 2, 2007 to July 31, 2008 (including electric power plant expenses) / 235 won from August 2008 (including electric power plant expenses): 234.5 won and the unit price for the 100g direction container: 150 won per unit price for the container (100 won for the container) : 200g direction container for the 200g direction container: 276 won per unit price for the container from July 31, 2007 to July 31, 2008 (i.e., the unit price for the 260g direction container to be supplied from August 25, 205 to 208).
