A defendant shall be punished by imprisonment for not less than three months.
Reasons
Punishment of the crime
On April 17, 2014, the defendant was sentenced to imprisonment with prison labor in Busan District Court for fraud, etc. and the above judgment became final and conclusive on the 25th of the same month.
1. Forgery of private documents;
A. On October 24, 2012, the Defendant: (a) entered “C” in the name column of the new contract form for the SK Telecom Services, “C” in the resident registration number column, “C” in the resident registration number column, “C” in the date of receipt, and “C” in the customer registration number column; and (b) signed “C” in the name following the name. For the purpose of exercising rights and obligations, the Defendant forged one copy of the new contract form under the name of “C”, which is a private document on the rights and obligations. (b) On August 13, 2012, the Defendant forged the document in the name of “F,” the resident registration number and address column, F in the name column, F in the resident registration number and address column, F in the name of “F”, “F in the name of the applicant” and “F,” and “C” in the name of the applicant “F,” following the entry column.
Accordingly, for the purpose of uttering, the Defendant forged a written application for subscription to a mobile phone in F, which is a private document related to rights and obligations.
(2) On October 25, 2012, the Defendant entered “F”, “F”, “F”, “F”, “F’s resident registration number, address column, and “F” on the date of receipt in the name column of the site for the new service contract, at the aforementioned mobile phone agent on October 25, 2012. Accordingly, the Defendant forged one copy of a new service contract under the name of F, a private document on rights and obligations, for the purpose of exercising rights and obligations. (3) On October 25, 2012, the Defendant entered “F”, “F”, “F’s resident registration number, address column, and date of receipt in the name column of the new contract for the SK Telecom Service,” “F”, “F” and “F” in the column of receipt.
